Experienced, Personal Advice in Uncontested Divorce
When both parties are capable of agreeing on all issues involved in the divorce, from property division issues to child custody and visitation matters, this is known as an uncontested divorce. As experienced divorce lawyers, we assist clients in establishing divorce settlement agreements, which properly address asset division, custody, support and other issues that the couple has agreed upon.
We offer flat rate uncontested divorce services. Our rates are affordable and include all costs including filing fees, copies, courier fees and postage. Our attorneys will prepare and file all necessary documents and will meet extensively with our client to ensure that they understand their legal rights, the agreement reflects the terms the parties have agreed to, and our client is comfortable with the document he or she is signing.
We cannot represent both parties.
We will represent one party, and will provide legal advice to only that party. Our only advice to the other party will be to review the agreement with an attorney. We also cannot conduct the consultation with both parties present.
Financial disclosures must be made.
Both parties will be required to make financial disclosures, regardless of whether you agree on all financial aspects of your case. We will prepare the financial documents for the party that retains us. We will provide a blank financial affidavit to the other party, but can provide no legal advice in completing it.
Live parenting courses are mandatory.
If the parties have minor children, both parties will be required to attend the live parenting course. The divorce will not be finalized until this course is completed. We will provide both parties with information of where and when this course is offered.
Uncontested divorce offers many benefits as the process is often less time-consuming, more cost-effective and less emotionally burdensome on all those involved. However, when disputes do arise, options remain for resolution outside of divorce litigation, including:
What is collaborative law?
Collaborative law divorce: Collaborative law is a method by which both parties to the divorce (and their respective attorneys) agree to a resolution outside of trial. Conferences are conducted in an open, honest atmosphere in which the parties come together to discuss important decisions involving property division, child custody and other family issues.
What is divorce mediation?
Divorce mediation: Mediation is a process by which the parties (and their respective attorneys – if applicable) attend negotiation meetings facilitated by a neutral, third party mediator.
Whether resolution is achieved through collaborative law or through mediation, uncontested divorce enables couples to maintain control over the critical decisions which impact their future and the future of their children.
Why hire an attorney for uncontested divorces?
While it is certainly possible to procure a divorce without attorneys, there are many procedures that must be followed and pitfalls that can be avoided with the assistance of a skilled lawyer. Our attorneys focus their practice exclusively on family law and marital issues and are here to provide you the guidance and advice you need.
